ACAS recently published its figures regarding early conciliation. The results indicated that the number of employees citing an issue with their employer over compliance breaches increased by over 12%, when compared to the previous year.

Close to 120,000 employees reported issues ranging from unfair dismissal to discrimination, as well as pay. This increase is the highest since pre-pandemic levels and showcases the need for businesses to ensure that they are fully compliant with the latest employment legislation and HR best practice.

The figures also indicated that the average claim for unfair dismissal was £13,541.

Head of HR Advisory at Croner, Dan Willson, commented:

“The continued increase in early conciliation, especially around unfair dismissal showcases the need for businesses to ensure that they are fully compliant when it comes to HR and Employment Law.

Now, more than ever, employers should be reviewing their contracts and documentation, especially with the Employment Rights Bill being so close to the implementation stage.

Businesses should be ensuring that they are familiar with the ACAS code of practice, especially in the case of dismissal, as any deviation from proper practice can potentially result in a tribunal claim.

It is imperative that business owners seek professional guidance if they are even remotely unsure about correct process.”
