What can employers expect to come into effect in Autumn 2025?
As per the Government's roadmap, as soon as the updated Employment Rights Bill receives Royal Assent then the following legislation will be implemented at either that point or shortly after:
- The Strikes (Minimum Service Levels) Act 2023 will be repealed.
- The Trade Union Act 2016 will have the majority repealed.
- The removal of the 10-year ballot requirement for trade union political funds.
- Simplified industrial action notices and industrial action ballot notices.
- Protections against dismissal for taking industrial action.
Other Employment Rights Bill updates expected late 2025
Alongside the changes that will immediately be passed as law, upon receiving Royal Assent, there are also a series of consultations expected. These are:
Autumn Employment Rights Bill consultations
- Consultation on employee ‘day one’ protections from unfair dismissal, including consultation on dismissal process during statutory probation period.
- Fair Pay Agreement for the Adult Care Sector.
- Trade union measures including electronic balloting, workplace balloting and simplifying the trade union process. The duty to inform workers of their right to join a trade union and the union right of access will also be covered as well as new rights for and protections for union representatives (under the Acas code of practice).
- Fire and rehire.
- Regulation regarding umbrella companies.
- Bereavement leave.
- Pregnant workers’ rights.
- Zero hours contracts.
Winter Employment Rights Bill consultations 2025/Early 2026
- Trade union measures such as protection against detriments for taking industrial action, and protection from blacklisting.
- Tightening of tipping laws.
- Collective redundancy.
- Flexible working.
